All about the Real Estate Violation (RVS) System in Dubai
Dubai’s real estate sector has changed tremendously in the past couple of decades. With huge foreign investments from individuals as well as industry giants, the emirate’s property market has emerged as a strong contributor to the economy. Dubai’s government has also done its part by introducing processes and laws that protects the rights of all parties involved. The Real Estate Violation System in Dubai also plays an important role in handling any violations in the property sector.
ALL YOU NEED TO KNOW ABOUT THE NEW RVS SYSTEM IN DUBAI
Given the complex nature of the real estate and property business, it’s possible for disputes to arise. However, a robust conflict management system can help to successfully address such conflicts.
The Real Estate Violation System or the RVS System works as an independent and impartial adjudicator to resolve any issues.
THE PURPOSE OF REAL ESTATE VIOLATION SYSTEM
The Real Estate Violation System is the simplest way to record any complaints to safeguard the rights of a party. The purpose of the RVS System is to implement the laws of the land in a transparent manner. UAE’s real estate market is an investment opportunity for a global audience and the Real Estate Violation System ensures that property management companies, brokerages, developers and valuation service providers have the necessary permits and are providing a high standard of service.
It enforces the law to ensure no illegal activities take place and all necessary processes are followed by the different real estate service providers. The system also provides quick and efficient solutions to minimise business disruptions.
COMPLAINT SCOPE
The Real Estate Violation System addresses specific concerns. It mainly looks at the potential violation committed by individuals or real estate offices in accordance with Law No. 16. This law came in effect in 2007 and was the basis of the establishment of the Real Estate Regulatory Agency (RERA).
Please note that the corporation is not allowed to register a complaint about disagreements over the terms of a contract or financial claims. Complaints regarding cancelling contracts or reservation between a real estate company and a client cannot be pursued through the RVS system. Any complaints regarding contractual matters are closed directly and the parties are advised to seek legal consultation.
Moreover, all complaints have to be made in the RVS system within six months of the alleged violation.
HOW TO REGISTER A COMPLAINT VIA THE RVS SYSTEM?
To register a complaint via the RVS system, you need to visit its official website. Alternatively, you can access the system through the Dubai Land Department website. Navigate to ‘Complaints and Suggestions’ under ‘E-services’ and select ‘Real Estate Company Violation Complaint’.
- On the homepage of the RVS system, you must select ‘Register Complaint’.
- An automated message will appear on the screen, requesting you to confirm that the complaint isn’t about a contract.
- You will then need to fill out a form with details of the complainant, defendant and project details.
- Make sure you have all the relevant documents (including identification document) scanned before you start the process. The Licence Number of the company you want to complain against is also required along with the ORN.
